1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your use of the Online Edge Tutors website (www.edgetutors.co.za) and the purchase of any products or services offered by Online Edge Tutors (“we”, “us”, “our”). By accessing our website, creating an account, or purchasing any product or service, you confirm that you have read, understood, and agree to be bound by these Terms in full.

If you do not agree to these Terms, you must not use our website or purchase our services.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including but not limited to:

  • Consumer Protection Act 68 of 2008 (CPA)
  • Electronic Communications and Transactions Act 25 of 2002 (ECTA)
  • Protection of Personal Information Act 4 of 2013 (POPIA)
  • Children’s Act 38 of 2005
  • Copyright Act 98 of 1978

2. Definitions

  • “Student” refers to the learner enrolled in or accessing our tutoring services, including live tutoring sessions, exam bootcamps, and online courses comprising pre-recorded lessons and digital educational content.
  • “Parent/Guardian” refers to the adult who registers and purchases services on behalf of a minor student. In accordance with the Children’s Act 38 of 2005, a minor is defined as any person under the age of 18 years.
  • “Account Holder” refers to the adult (parent or guardian) who creates and holds the registered account on www.edgetutors.co.za.
  • “Services” refers to all tutoring, educational content, live sessions, recorded lessons, online courses, exam bootcamps, and any other products or services offered by Online Edge Tutors.
  • “Digital Content” refers to pre-recorded lessons, online course materials, downloadable resources, and any other online educational media provided by Online Edge Tutors.
  • “Live Sessions” refers to scheduled virtual classes, exam bootcamps, or live tutoring sessions conducted via video conferencing platforms.
  • “Meeting Link” refers to the virtual meeting access link (via Zoom, Google Meet, or similar platform) provided to a purchaser for access to a Live Session or Exam Bootcamp.
  • “Tutor” refers to an independent contractor engaged by Online Edge Tutors to deliver tutoring or instructional services through the platform.

3. Account Registration and Minor Protection

All accounts must be registered by the parent or legal guardian of the student where the student is a minor under the age of 18 years, as defined in the Children’s Act 38 of 2005. By registering, you confirm that:

  • You are an adult of 18 years or older.
  • You are providing your own personal details as the parent or guardian, and not those of the student.
  • The information you provide is accurate, complete, and up to date.
  • You are legally authorised to enter into this agreement on behalf of the student.

Should a minor register on this platform without parental or guardian consent, whether by misrepresenting their age or by using another person’s details, Online Edge Tutors shall bear no liability whatsoever for any consequences arising from such registration, including but not limited to the collection or processing of the minor’s personal information, the purchase of services, or any financial transactions made. In such circumstances, Online Edge Tutors reserves the right to cancel the account and any associated purchases immediately and without refund.

Online Edge Tutors takes reasonable steps to ensure that accounts are created by adults; however, we cannot be held responsible for false or fraudulent information submitted during registration. It remains the responsibility of the adult parent or guardian to monitor and manage their child’s online activity and to ensure that their child does not register independently or share personal information online without parental oversight.

4. Products and Services

4.1 Pre-Recorded Lessons and Online Courses

Pre-recorded lessons and online course content are made available for online streaming once payment has been confirmed. Access is granted to the enrolled student via the registered account only. These lessons and course materials may not be downloaded, copied, distributed, shared, or reproduced in any format without the prior written consent of Online Edge Tutors.

4.2 Live Tutoring Sessions

Live sessions are scheduled at fixed dates and times. It is your responsibility to ensure that the student has a stable internet connection, a functioning device, a reliable power supply, and is available and ready at the scheduled time. Online Edge Tutors will not be held liable for missed or disrupted sessions resulting solely from circumstances on your side, such as:

  • The student’s absence or late attendance.
  • Load shedding, power failures, or electrical outages on your side.
  • Slow, unstable, or unavailable internet connectivity on your side.
  • Device or computer malfunctions or technical difficulties on your side.

Online Edge Tutors will make reasonable efforts to ensure sessions run as scheduled and provide reliable platform access. In the event that a session is cancelled or significantly disrupted due to circumstances on Online Edge Tutors’ side (for example, our own technical failure), we will offer a rescheduled session, alternative access, or an appropriate remedy at our discretion.

4.3 Exam Bootcamp Events

Exam Bootcamps are fixed-schedule virtual events comprising multiple sessions. Access details, including the Meeting Link, will be provided via email following confirmed payment. Students are expected to attend all sessions. Missed sessions within a bootcamp cannot be rescheduled unless at the sole discretion of Online Edge Tutors.

Where Online Edge Tutors makes recordings of Live Sessions or Bootcamp sessions available to enrolled students, such recordings are provided strictly for the personal revision use of the enrolled student only. Recordings may not be shared, forwarded, downloaded, distributed, or used for any purpose other than the enrolled student’s own personal study.

5. Purchases and Payment

All prices are displayed in South African Rand (ZAR) and are exclusive of VAT. Online Edge Tutors is not currently registered as a VAT vendor. Payment is required in full before access to any service or digital content is granted.

By completing a purchase, you confirm that:

  • You have reviewed and are satisfied with the product or service description.
  • You are purchasing the correct product for your intended purpose.
  • You understand the nature and format of the service being purchased.
  • You are making this purchase willingly and without coercion.

6. Refund and Cancellation Policy

Online Edge Tutors provides educational services and digital content. Your statutory rights under the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA) are not affected by these Terms, and nothing in this section is intended to override or waive those rights.

6.1 No Refunds for Accessed Digital Content

Once a student has accessed, streamed, or viewed any pre-recorded lesson or digital content (which constitutes performance of the service under ECTA), no refund will be issued. By accessing the content, you confirm that you have received the service as described.

6.2 No Refunds Once Meeting Link Has Been Issued

For Live Sessions and Exam Bootcamps, no refund will be issued once the Meeting Link has been sent to the registered email address, as this constitutes delivery of a material part of the service under ECTA. This applies regardless of whether the student attended the session or experienced technical difficulties solely on your side.

6.3 Cooling-Off Period

Under Section 44 of ECTA, you may have a seven (7) day cooling-off period from the date of purchase to cancel, provided that:

  • You have NOT yet accessed any digital content or pre-recorded lesson.
  • The Meeting Link for any Live Session or Exam Bootcamp has NOT yet been issued to you.
  • You notify us in writing at info@edgetutors.co.za within seven days of purchase.

We cannot waive or override your statutory rights under ECTA or the CPA. However, no refunds or remedies will be available for circumstances outside our reasonable control, including technical issues on your side, load shedding, power failures, internet outages, or non-attendance by the student.

6.4 Defective or Incorrectly Described Services

If a service is materially defective, of poor quality, or significantly different from its description, you may request a repair, replacement, or refund in accordance with your rights under sections 54 to 56 of the CPA. Please contact us at info@edgetutors.co.za within 10 business days of discovering the issue. We will investigate and respond promptly.

6.5 Change of Mind and Academic Outcomes

A change of mind, unwillingness to participate, or dissatisfaction with academic outcomes does not entitle you to a refund, as these services are performed upon access. Online Edge Tutors is committed to delivering quality educational content and qualified instruction; however, no guarantee or promise is made regarding improved grades, academic performance, or any specific educational outcome. Results are dependent on the individual effort, participation, and commitment of the student.

7. Intellectual Property and Copyright

All content produced, published, or distributed by Online Edge Tutors, including but not limited to videos, lesson notes, worksheets, presentations, exam preparation materials, recorded sessions, and website content, is the exclusive intellectual property of Online Edge Tutors and is protected under the Copyright Act 98 of 1978.

You are strictly prohibited from:

  • Downloading, copying, reproducing, or duplicating any content without prior written consent from Online Edge Tutors.
  • Sharing, distributing, reselling, or redistributing any content to third parties.
  • Recording live sessions without the express written permission of Online Edge Tutors.
  • Using any content for commercial purposes or for personal financial gain.
  • Uploading or publishing any Online Edge Tutors content to third-party platforms including YouTube, social media, file-sharing sites, or any other platform.

Licences granted for access to digital content and recorded sessions are personal, non-transferable, and non-exclusive. Purchased access may not be resold, gifted, or transferred to another person under any circumstances.

Any unauthorised use of our intellectual property may result in immediate termination of access without refund, and may expose the offending party to civil and criminal liability under South African law.

8. Non-Transferability of Services

All purchases made through www.edgetutors.co.za are for the sole personal use of the registered account holder and the designated student for whom the service was purchased. Services and digital content may not be:

  • Sold, resold, or transferred to another person or entity.
  • Shared via login credentials with any third party.
  • Used for group or classroom instruction without a separate commercial licence agreement with Online Edge Tutors.

Where Online Edge Tutors provides recordings of live sessions to enrolled students, such recordings are strictly for the personal revision use of the enrolled student only and may not be shared with or accessed by any other person.

Online Edge Tutors reserves the right to terminate access immediately, without refund, if it is found that account credentials, content, or recordings are being shared or misused.

9. Tutor Conduct and Parental Responsibility for Online Safety

All tutors engaged by Online Edge Tutors are independent contractors who are bound by a separate Tutor Agreement, Non-Disclosure Agreement, and Code of Conduct. Online Edge Tutors vets tutors reasonably and monitors sessions where possible. Tutors are strictly prohibited from:

  • Contacting any student directly via personal phone numbers, personal email addresses, social media platforms, or any communication channel outside of the official Online Edge Tutors platform.
  • Soliciting, requesting, or accepting personal contact details from students.
  • Engaging in any personal, romantic, or inappropriate relationship with any student.
  • Sharing, distributing, or using any student’s personal information for any purpose outside of delivering the agreed tutoring service.

Should a student voluntarily share their personal contact details with a tutor outside of the platform, Online Edge Tutors shall bear no liability whatsoever for any communication, conduct, or consequences arising from such contact. The sharing of personal information by a student with a tutor outside of the platform occurs entirely outside of Online Edge Tutors’ control and knowledge.

Online Edge Tutors strongly advises parents and guardians to:

  • Educate their child on responsible online behaviour and the importance of not sharing personal contact details with anyone online, including tutors.
  • Monitor their child’s online sessions and communications.
  • Report any inappropriate conduct by a tutor immediately to Online Edge Tutors at info@edgetutors.co.za.

The parent or guardian accepts full responsibility for their child’s online safety and conduct during and outside of scheduled sessions. Online Edge Tutors will take all reasonable steps to investigate and act upon any reported misconduct by a tutor. Any tutor found to have breached the Online Edge Tutors Code of Conduct will be immediately suspended, and serious cases will be reported to the relevant authorities.

10. Privacy and Protection of Personal Information

Online Edge Tutors is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). By using our services, you consent to the collection, processing, and storage of your personal information as described in our Privacy Policy, available on our Privacy Policy page. Where a student is a minor, the parent or guardian’s consent covers the processing of the student’s personal information.

We will not sell your personal information to third parties. Your information is used solely for the purpose of providing our educational services, communicating with you, and complying with our legal obligations.

11. Limitation of Liability

To the extent permitted by South African law, including section 51 of the CPA, Online Edge Tutors shall not be held liable for:

  • Any indirect, incidental, or consequential loss arising from the use of our services.
  • Technical interruptions, platform outages, or connectivity failures beyond our control.
  • Academic outcomes, results, or performance of students.
  • Loss of data due to circumstances beyond our reasonable control.
  • Any loss or disruption caused by load shedding, power failures, or internet outages on your side.
  • Any conduct, communication, or actions by a tutor that occur outside of the official Online Edge Tutors platform and beyond Online Edge Tutors’ reasonable knowledge or control.

Online Edge Tutors’ total liability to you shall not exceed the amount paid by you for the specific service giving rise to the claim. Services are provided with reasonable care and skill, and this limitation does not affect your statutory rights under the CPA.

12. Acceptable Use and Conduct

All users of our services are expected to behave respectfully and professionally. Online Edge Tutors reserves the right to remove any student from a live session or terminate access to services without refund if the student or parent/guardian:

  • Engages in abusive, disrespectful, or disruptive behaviour toward instructors or other participants.
  • Attempts to record, screenshot, or capture live sessions or digital content without permission.
  • Breaches any provision of these Terms and Conditions.

13. Changes to These Terms

Online Edge Tutors reserves the right to update or amend these Terms at any time. Where changes are material, we will provide at least 14 days’ notice via email to registered account holders. Continued use of our services following notice of changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes may be referred to the National Consumer Commission or relevant consumer court in terms of the Consumer Protection Act.
